{"id":29324,"date":"2022-01-07T19:00:31","date_gmt":"2022-01-07T18:00:31","guid":{"rendered":"https:\/\/www.domingues-immo.ch\/?p=29324"},"modified":"2022-01-07T19:15:50","modified_gmt":"2022-01-07T18:15:50","slug":"frais-de-notaire-et-transaction-immobiliere","status":"publish","type":"post","link":"https:\/\/www.domingues-immo.ch\/?p=29324","title":{"rendered":"Frais de notaire et transaction immobili\u00e8re"},"content":{"rendered":"<section class=\"kc-elm kc-css-795545 kc_row\"><div class=\"kc-row-container  kc-container\"><div class=\"kc-wrap-columns\"><div class=\"kc-elm kc-css-767600 kc_col-sm-12 kc_column kc_col-sm-12\"><div class=\"kc-col-container\"><div class=\"kc-elm kc-css-978872 kc_text_block\"><\/p>\n<p>Lorsque vous projetez d\u2019acqu\u00e9rir un bien immobilier, vous vous fixez un certain budget.<\/p>\n<\/p>\n<p>G\u00e9n\u00e9ralement ce dernier n&#039;est pas extensible car il est bas\u00e9 sur votre capacit\u00e9 \u00e0 emprunter, donc sur vos revenus et votre apport (ce calcul aura \u00e9t\u00e9 fait par une banque ou nous pour que vous soyez au clair.<\/p>\n<\/p>\n<p>Or, il ne faut pas oublier de prendre en compte les \u00ab\u00a0frais de notaire\u00a0\u00bb, qui repr\u00e9sentent un certain pourcentage du montant de la transaction, \u00e0 ajouter \u00e0 ce dernier.<\/p>\n<\/p>\n<\/p>\n<p class=\"has-custom-size\" style=\"font-size:30px\"><strong>Porquoi, comment, des frais de notaire ?<\/strong><\/p>\n<\/p>\n<p>L\u2019acquisition d\u2019une maison ou d\u2019un appartement est soumise \u00e0 des frais dits \u00ab\u00a0de notaire\u00a0\u00bb, parce que toute transaction immobili\u00e8re doit \u00eatre formalis\u00e9e par un acte notari\u00e9 (acte authentique = forme obligatoire, exig\u00e9e). <\/p>\n<\/p>\n<p>Celui-ci s\u2019accompagne alors de diff\u00e9rents frais support\u00e9s uniquement par l\u2019acheteur, sauf accord contractuel avec le vendeur. En contrepartie, c\u2019est l\u2019acqu\u00e9reur, qui choisit le notaire. Selon entente entre les parties, le vendeur peut aussi les prendre \u00e0 charge. C&#039;est une discussion, entente \u00e0 trouver.<\/p>\n<\/p>\n<p>Le notaire applique des frais diff\u00e9rents selon les cantons. Si certains leur imposent des taux fixes inversement proportionnels au montant de la vente, d\u2019autres laissent au notaire d\u00e9terminer librement ces taux. Dans cette situation, le futur acqu\u00e9reur a donc tout int\u00e9r\u00eat \u00e0 se renseigner et \u00e0 faire jouer la concurrence entre les diff\u00e9rents notaires.<\/p>\n<\/p>\n<p>Par ailleurs, il faut noter qu\u2019en ce qui concerne le canton de Vaud, il existe deux types de notariats\u00a0: le notariat \u00ab\u00a0latin\u00a0\u00bb, dans lequel le notaire exerce en tant qu\u2019ind\u00e9pendant, le plus souvent en cabinet\u00a0; et le notariat \u00ab\u00a0officiel\u00a0\u00bb, o\u00f9 le notaire est un fonctionnaire de l\u2019\u00c9tat helv\u00e9tique.<\/p>\n<p><span style=\"font-style: inherit;\">dget initial, n\u2019oubliez pas de consid\u00e9rer ces frais suppl\u00e9mentaires, sous peine d\u2019\u00eatre confront\u00e9 \u00e0 de mauvaises surprises.<\/span><\/p><\/p>\n<\/div><div class=\"kc-elm kc-css-66169 kc_shortcode kc_single_image\">\n\n        <img src=\"https:\/\/www.domingues-immo.ch\/wp-content\/uploads\/2022\/01\/notaire-II.jpg\" class=\"\" alt=\"\" \/>    <\/div>\n<div class=\"kc-elm kc-css-477444 kc_text_block\"><\/p>\n<p><strong style=\"font-style: inherit; font-size: 30px;\">Comment se d\u00e9composent les frais de notaire\u00a0?<\/strong><\/p>\n<\/p>\n<p>Maintenant que vous savez pourquoi vous devez payer des \u00ab\u00a0frais de notaire\u00a0\u00bb ils sont d\u00e9termin\u00e9s en trois blocs, car non, ils ne permettent pas uniquement de r\u00e9mun\u00e9rer le notaire.<\/p>\n<\/p>\n<p>Avant cela, il faut tout d\u2019abord distinguer les deux op\u00e9rations qui accompagnent une transaction immobili\u00e8re\u00a0: acte de vente et acte hypoth\u00e9caire, ce dernier \u00e9tant \u00e9galement d\u00e9nomm\u00e9 \u00ab\u00a0c\u00e9dule hypoth\u00e9caire\u00a0\u00bb.<\/p>\n<\/p>\n<\/p>\n<p><em>La c\u00e9dule hypoth\u00e9caire (de registre ou au porteur), est le papier valeur correspondant au montant que vous aurez &#8220;en dette\". Elle est inscrite au RF et fait donc partie int\u00e9grante de l&#039;extrait du RF. J&#039;aurai l&#039;occasion de vous d\u00e9tailler via un autre article les c\u00e9dules hypoth\u00e9caires.<\/em><\/p>\n<\/p>\n<\/p>\n<p class=\"has-custom-size\" style=\"font-size:30px\"><strong>Frais relatifs \u00e0 l\u2019acte de vente<\/strong><\/p>\n<\/p>\n<p>Le montant total des frais \u00e0 verser au notaire s\u2019\u00e9l\u00e8ve \u00e0 peu pr\u00e8s \u00e0 4\u00a0% du montant du bien immobilier. Il se d\u00e9compose en trois quotit\u00e9s\u00a0: droits d\u2019enregistrement \u2013 ou droits de mutation\u00a0\u2013, inscription au Registre foncier, et \u00e9moluments du notaire\u00a0\u2013 ainsi que les frais \u00e9ventuels que celui-ci a avanc\u00e9s. Dans le d\u00e9tail, les parts de chacun repr\u00e9sentent\u00a0:<\/p>\n<\/p>\n<ul>\n<li>3,3\u00a0% du prix de vente pour les droits de mutation dans le canton de Vaud, pourcentage qui peut \u00e9voluer en fonction des cantons\u00a0;<\/li>\n<li>0,3\u00a0% environ pour l\u2019inscription au Registre foncier, dont le tarif est fix\u00e9 par les communes avec un calcul diff\u00e9rent selon les cantons, et dont le montant lui est revers\u00e9 in fine\u00a0;<\/li>\n<li>entre 0,5\u00a0% et 0,7\u00a0% environ pour r\u00e9mun\u00e9rer le notaire.<\/li>\n<\/ul>\n<\/p>\n<p>Il est important de pr\u00e9ciser ici que, concernant les droits de mutation, le notaire n\u2019est qu\u2019un interm\u00e9diaire, c\u2019est-\u00e0-dire que la somme que vous lui versez est ensuite transf\u00e9r\u00e9e directement \u00e0 l\u2019\u00c9tat. Le notaire g\u00e9n\u00e9ralement vous demande une provision apr\u00e8s la signature de l&#039;acte pour couvrir les frais.<\/p>\n<\/p>\n<\/p>\n<p class=\"has-custom-size\" style=\"font-size:30px\"><strong>Frais direct, li\u00e9s \u00e0 la c\u00e9dule hypoth\u00e9caire<\/strong><\/p>\n<\/p>\n<\/p>\n<p>Dans le cas o\u00f9 vous sollicitez\u00a0un emprunt hypoth\u00e9caire aupr\u00e8s d\u2019un organisme financier en vue d\u2019acqu\u00e9rir le bien immobilier de vos r\u00eaves. Dans cette situation, le notaire doit alors cr\u00e9er une c\u00e9dule hypoth\u00e9caire. Il s\u2019agit d\u2019un titre, \u00e9mis par le Registre foncier, qu\u2019exige le pr\u00eateur avant de d\u00e9bloquer les fonds demand\u00e9s. <em>A noter qu&#039;il peut y avoir des c\u00e9dules avec plusieurs rangs, mais l\u00e0 aussi j&#039;y reviendrai dans un sujet qui y sera consacr\u00e9.<\/em><\/p>\n<\/p>\n<p>Le plus souvent, les frais associ\u00e9s sont \u00e9quivalents \u00e0 2,5\u00a0% du montant du pr\u00eat. Ils s\u2019ajoutent aux frais dits \u00ab\u00a0de notaire\u00a0\u00bb dus dans le cadre de l\u2019acte de vente et explicit\u00e9s pr\u00e9c\u00e9demment.
